Terms of Use
Version 2026-09-30effective September 30, 2026
This is a reference version, translated for ease of reading. In the event of any discrepancy, the Portuguese version prevails.
These Terms of Use describe the conditions for contracting and using AttendTo — a virtual AI SDR platform for lead qualification. By creating an account, expressly accepting these Terms when requested or subscribing to a plan, you agree to the applicable conditions below. Read these Terms carefully before using the Platform: they contain important information about rights, obligations, billing, data and continuity of the service. These Terms are supplemented by our Privacy Policy, which describes how we collect, use and protect personal data — yours and that of your leads.
Who provides AttendTo
The AttendTo platform is developed and operated by RYTORA AI TECHNOLOGY & SOLUTIONS LTDA, a private-law legal entity registered under CNPJ No. 62.234.242/0001-05 ("RYTORA" or "AttendTo"). Every reference to AttendTo in these Terms and in the Privacy Policy refers to that company.
Subject matter
AttendTo offers a usage license to its virtual SDR platform with artificial intelligence, which qualifies leads received via WhatsApp, records the journey in a CRM and hands the conversation off to a human on your team when necessary. These Terms govern the use of the Platform by the Customer ("you") and its team.
Registration and Customer obligations
When creating an account, you declare that the registration information provided is true and up to date, and you are responsible for keeping your access credentials confidential and for all activity carried out on your account, including by the agents you invite to the team.
You represent that you have the standing and legal basis to contact your leads on WhatsApp, in compliance with the Meta/WhatsApp Business commerce policy and applicable data protection law. In this relationship, you (the customer) are the controller of your leads' personal data, and AttendTo acts as the processor, processing that data on your behalf to provide the service — see our Privacy Policy for more details. It is prohibited to use the platform for unlawful, discriminatory, or fraudulent purposes, or to send unsolicited messages in violation of the channel's rules.
Acceptance, versions and electronic evidence
When the Platform requests express acceptance of these Terms, the expression of acceptance will be associated with the account and the user who performed the act and recorded with the version accepted, date and time and sufficient technical evidence, including IP address and identification of the browser or device (user agent), when available. AttendTo will preserve a complete copy or verifiable record of each version accepted to prove the contract, for security, fraud prevention and regular exercise of rights.
The evidence of acceptance will be retained throughout the contractual relationship and for at least 5 (five) years after it ends, without prejudice to any longer legal period. A new version may require new acceptance when it materially changes rules on billing, continuity, account use, data protection or other relevant conditions.
Meta's commerce policy and your industry
WhatsApp is a channel with an owner. Meta maintains a commerce policy that defines what may and may not be offered there, and it applies to you, to us and to any company using the official channel. By contracting, you declare that your activity and the way you intend to use the Platform fit within the categories that this policy allows.
Some industries are prohibited, and others are allowed only with restrictions — alcoholic beverages, weapons and ammunition, payroll-deducted loans and other loan offers, regulated health products and medicines, betting and games of chance, among others. This list is an example, not the rule: the rule is Meta's policy, which changes without depending on us. Check your case in Meta's document before contracting — a closed list here would become outdated, and outdated text misleads more than it helps.
If your industry or your messaging practices put our integration with Meta at risk, we may refuse to open an account or close an account that is already open. This is not the same as the suspension for violation described below: there, a breach has occurred; here, there is an incompatibility with the channel's rules. For that reason, we give at least 30 (thirty) days' notice and keep the service running during that period, so you can export your data and plan your exit — except when Meta or the law requires immediate action.
Migration of your WhatsApp number
For the AI SDR to handle conversations, the number must be on the official WhatsApp Business platform (Meta's API). Migrating to it a number that currently runs on regular WhatsApp or the WhatsApp Business app is a Meta procedure: we guide and follow it, but it is Meta that authorizes, approves and executes it.
What changes when the number moves to the official API: it stops working in the mobile app, the history stored on that device does not come along, and messages sent outside the 24-hour window start to require message templates previously approved by Meta.
The way back exists and is also in Meta's hands. Taking the number off the API to use it again in the regular app follows Meta's rules and deadlines, including waiting periods before the number can be registered again. We control neither the rules nor the deadlines, and therefore we promise neither a date nor a guarantee of success.
Before migrating a number that your team already uses, weigh three things: whether anyone depends on the mobile app to handle conversations on it, whether the history on that device will be missed, and whether it is worth starting with a secondary number. It is the hardest decision to undo in the entire implementation.
Pricing
AttendTo charges under two models, which can be used separately or together: prepaid balance (you top up and pay only for what the AI processes) and the AttendTo Pro monthly plan (a subscription with an included allowance of AI credits). The current amounts for each model are always described on the pricing page of the website and in the Wallet in the dashboard — we do not repeat them here to avoid discrepancies. On a Partner Account, the amounts are those in the proposal and in the screens presented under the partner's brand, as set out in the specific section above.
AttendTo may adjust the amounts over time. Any adjustment is always reflected beforehand on the pricing page and in the Wallet, and never applied retroactively to a cycle already paid: an adjustment to the AttendTo Pro plan only takes effect in the next renewal cycle, and an adjustment to the prepaid balance only applies to top-ups made after the change.
The charge for each voice audio processed is capped at 10 minutes: even if the audio sent by the lead is longer, you never pay for more than that in a single audio.
How payment is processed
AttendTo does not process payments itself: that is done by a payment institution engaged by us — currently Mercado Pago or Asaas, depending on how your account was contracted. Your card details are entered in that institution's environment, and AttendTo never has access to them at any time.
The accepted methods are Pix, boleto and card. The final choice is made on the payment institution's page, not in our dashboard. Every confirmed payment becomes a line in the Wallet statement, which you can check whenever you want and export as CSV.
Amounts are in reais and already include the taxes that currently apply to the service — there is no surcharge afterward. If new taxes are created or tax rates change, the amounts may be adjusted to the same extent, with notice before taking effect. Withholdings that the law requires of you, as the service recipient, are your responsibility. The service invoice is issued for each confirmed payment, provided the CNPJ is registered in the dashboard; on a Partner Account, issuance follows the specific section above.
If you do not recognize a charge, write to contato@attendto.com.br within 60 (sixty) days of the entry appearing on your Wallet statement, and we will investigate. After that period, the entry is considered accepted for the purposes of this agreement — which does not affect the rights that consumer protection law guarantees regardless of any contractual deadline.
Automatic plan renewal
By subscribing to the AttendTo Pro plan, you enter into a monthly subscription with automatic renewal: each cycle, the monthly fee is charged automatically to the registered payment method, and the included allowance of AI credits is renewed (without carrying over unused balance from the previous cycle). Renewal continues until the subscription is canceled, subject to the specific rules for Partner Accounts.
Cancellation
You can cancel the AttendTo Pro plan at any time, directly in the Wallet, with no penalty and no red tape. When you cancel, the plan benefits (the AI allowance and human handoffs at no additional cost) remain in effect until the end of the period already paid — there is no prorated refund of the current monthly fee, except where the right of withdrawal described below applies. Your prepaid balance is not affected by canceling the plan; top-up balance in a Partner Account follows the rules displayed for that account type and applicable law.
Right of withdrawal (Art. 49 of the Brazilian Consumer Protection Code (CDC))
Because the contract is entered into outside a commercial establishment (over the internet), you have 7 (seven) calendar days from confirmation of payment of the first monthly fee to withdraw, without having to give a reason. If exercised within that period, cancellation results in a full refund of the monthly fee paid. After the 7 days, the penalty-free cancellation rule described above applies.
The provision of this section does not turn into a consumer relationship a contract that legally does not have that nature, nor does it waive any right that the law mandatorily guarantees.
Suspension for non-payment
If payment of a monthly fee for the AttendTo Pro plan is not confirmed, you have a grace period of 5 (five) calendar days to settle it, unless a specific rule displayed for your account type provides otherwise. If payment is still not confirmed when that period ends, the plan benefits (the AI allowance and human handoffs at no additional cost) are suspended until the payment is settled. This suspension never affects your prepaid balance: if you have balance available, the AI SDR keeps responding normally, charging usage against that balance.
Late payment charges
Paying late has a cost, and it is better to write the number down than to leave it open. Overdue amounts are subject to a penalty of 2% (two percent), default interest of 1% (one percent) per month, calculated day by day, and monetary adjustment based on the IPCA/IBGE index — or any index that replaces it —, counted from the due date until payment.
These are late-payment charges: they apply to the overdue, unpaid monthly fee, and only to it. They are unrelated to canceling the plan, which remains free of penalties. The immediate effect of late payment is still the suspension of benefits described above; the charges apply when collection of the outstanding amount takes place.
Suspension and termination for violation
In addition to the suspension for non-payment provided for above, AttendTo may suspend or terminate access to the Platform, in whole or in part, in the event of unlawful use, fraud, attempts to circumvent system security, sending of messages in breach of WhatsApp/Meta rules, or serious breach of these Terms. Whenever the urgency of the case allows, AttendTo will use its best efforts to notify the Customer at least 48 (forty-eight) hours before the suspension, giving an opportunity to cure; in situations of immediate risk to security or to third parties, suspension may be immediate, with notice given afterward. Termination for violation does not give rise to a refund of amounts already paid, subject to the right of withdrawal described above where still applicable.
Intellectual property
The AttendTo brand, the software, the artificial intelligence agents, the integrations, the design of the Platform and all documentation are the property of AttendTo or its licensors, protected by applicable intellectual property law. Entering into these Terms grants you a non-exclusive, non-transferable usage license limited to the term of the contract, solely for the purposes set out herein — no transfer of ownership takes place.
The data you enter into the Platform (leads, messages, persona settings and offer catalog) remains your property. By using AttendTo, you grant it only the license necessary to process, store and display this data, exclusively to provide the contracted service.
Confidentiality
The parties undertake to keep confidential any confidential information to which they have access through use of the Platform — on one side, the Customer's lead data, commercial strategies and settings; on the other, the non-public details of how AttendTo operates. This information may be used only for the purposes set out in these Terms and must not be disclosed to third parties without authorization, except where required by law or by order of a competent authority. This duty of confidentiality remains in force even after the contract ends.
Information security
AttendTo employs appropriate technical and organizational measures to protect the Platform and the data processed — such as per-customer data isolation, encryption in transit and role-based access control, detailed in the Privacy Policy. Even so, you acknowledge that no data transmission over the internet is entirely free from risk: AttendTo works to reduce such risks as far as possible, but cannot guarantee absolute security against unauthorized access resulting from factors beyond its reasonable control.
Limitation of liability
AttendTo uses its best efforts to keep the Platform available and working properly, but does not guarantee uninterrupted availability or specific business results (such as a number of converted leads): the AI SDR is a support tool, and final business decisions remain with you and your team.
Part of the service depends on third-party providers beyond AttendTo's control — the messaging channel (WhatsApp/Meta), the artificial intelligence model providers, the calendar you connect (Google Calendar) and the payment institutions (Mercado Pago and Asaas) —, whose unavailability or changes may temporarily affect the operation of the Platform. To the extent permitted by law, AttendTo's liability for direct damages proven to have been caused by a failure of the Platform is limited to the amount you paid in the 12 (twelve) months prior to the event, and AttendTo is not liable for indirect damages, lost profits or loss of business opportunity. This limitation does not apply in cases of willful misconduct, gross negligence, or rights that consumer protection legislation does not allow to be waived.
When the channel fails, blocks or changes its rules
The most visible part of the service takes place inside a channel that is not ours. AttendTo is not liable for: unavailability of WhatsApp or other Meta services; blocking, sending restrictions or banning of your number as decided by Meta; unilateral changes to policy, sending rules or pricing made by Meta; and loss of your access to your own Meta account. None of these decisions goes through us, and we cannot reverse any of them.
A disclaimer of liability cannot become a blank check, so we write down what we still owe even in these cases: the Platform keeps working on the other channels you have active; your data remains intact and accessible in the dashboard; export remains available; and our support helps as far as it can to restore the channel, including in dealing with Meta when that is possible. If the interruption drags on and you do not wish to continue, cancellation remains available under the rules already described.
Use of your name and brand
By default, AttendTo may cite your company's name and logo as a customer in promoting the product — website, use cases and sales material. Only that: the citation is always truthful and never reveals data about your leads, figures from your business or the content of your conversations, which require specific, separate authorization.
You may opt out of this publicity at any time, without having to explain why: write to contato@attendto.com.br. From the date of your request, we stop using your name in new material and remove it from the pages and materials we control within 30 (thirty) days. Material that has already been printed, distributed, or republished by third parties may continue to circulate — we have no way to recall what has left our hands — but we will not reprint or republish that material.
Once the contract has ended, we stop presenting you as a current customer. To keep using your case after that, we ask for your confirmation: silence does not count as authorization.
If your account was contracted through a partner, this default authorization does not apply — in that case, we only publicize your name with specific written authorization.
Anti-corruption
Each party undertakes to the other to comply with Brazilian anti-corruption legislation, in particular Law No. 12,846/2013. Neither party offers, promises, authorizes or accepts any undue advantage — to a public official or a private party — in connection with this contract, whether directly or through third parties acting on its behalf. Proven non-compliance is grounds for immediate termination, without prejudice to the liabilities provided by law.
Assignment of this contract
You may not transfer your position under this agreement to another person or company without our written consent. AttendTo may assign its own in the event of a corporate reorganization, merger, consolidation, acquisition, or transfer of business, with the conditions you subscribed to remaining unchanged — same price, same terms, with no restart of any period because of the assignment. We will notify you when this happens.
Changes to these Terms and re-acceptance
AttendTo may amend these Terms to reflect changes in the product, legislation, security or commercial conditions. Each version will be identified, and relevant changes will be communicated by registered email and/or a notice in the dashboard.
Non-material changes may take effect upon notice and continued use, where legally permissible. When a new version materially changes billing, continuity, data processing, or relevant rights or obligations, or when the Platform itself indicates "mandatory re-acceptance", the new version will be used as the basis for actions that depend on it only after express acceptance has been recorded. Until re-acceptance, AttendTo may keep available only the functions compatible with the previously accepted version, preserving the access necessary to the data and the Customer's non-waivable rights. If you do not agree with a change that materially reduces your rights, you may cancel without penalty, in accordance with the "Cancellation" section above.
Support
Support to the Customer is provided by email at contato@attendto.com.br and through the support channels indicated in the dashboard. AttendTo seeks to respond to requests within a reasonable time, prioritizing issues that affect the operation of the service.
On a Partner Account, the partner provides first-level support and AttendTo acts as second level, without prejudice to direct contact where necessary for security, privacy, legal obligation or continuity of the account. The privacy channels indicated in the Privacy Policy remain open to you at any time, without going through anyone.
Venue and contact
These Terms are governed by the laws of the Federative Republic of Brazil. Questions about them may be sent to contato@attendto.com.br. The venue of the Customer's place of domicile is elected to settle any disputes, unless otherwise provided by law.
